Metallica's New Cosmetic Battle

December 12, 2000 -- Getting ready for a glitzy night on the town? Try some Metallica …

The hard rocking quartet is defending its name against this unlikely confusion for the second time, as it filed a lawsuit Friday against a fragrance manufacturer selling "Metallica" perfume.

The suit, filed at the U.S. District Court for the Central District of California, charges that French manufacturer Guerlain "has caused confusion and is likely to continue to cause confusion, deception, and mistake in the minds of the public with respect to the source and origin of defendants' goods."

The band settled a similar lawsuit in January against Victoria's Secret, which was marketing a line of lip pencils called "Metallica."

Whether the perfume actually smells like the members of Metallica was unclear from the latest suit.
